illegal parking, drop kerbs, turning circles commercial vehicles??
I live in a cul-de-sac and several of my neighbours park covering the whole foot path. They also have commercial vans parked in a turning circle and covering a fire hydrant. These vehicles in some instants are over dropped kerbs.
Is any of this illegal and can i get anyone to do something about it???
I have asked my neighbours to be more considerate and most just ignore the issue.
Feed back is appreciated.
OK – this is a very annoying situation because only one of the problems you mention are potentially illegal:
Parking on the pavement (even partially) is illegal in London. However, outside London, you “should not park on the pavement” as the the Highway Code states. (see below for meaning of “should not”)
Parking over dropped kerbs is not illegal – unfortunately! The Highway Code states: Do not stop or park…
* where the kerb has been lowered to help wheelchair users and powered mobility vehicles.
* in front of an entrance to a property
Similarly it states: Do not stop or park…
* anywhere you would prevent access for Emergency Services
So I guess that includes over Fire Hydrants?
Regarding the terms “should not” and “do not” written in the Highway Code. “failure to comply with the other rules of the Code will not, in itself, cause a person to be prosecuted, The Highway Code may be used in evidence in any court proceedings under the Traffic Acts to establish liability” http://www.direct.gov.uk/en/TravelAndTransport/Highwaycode/DG_070236
What I would recommend you do is contact your local police, as they will know more as to which, if any Acts or Regulations your neighbours could be contravening, and therefore, if there is anything you can do about it
